1. ΑΣΦΑΛΙΣΤΙΚΗ ΚΑΛΥΨΗ ΠΡΟΣ ΤΡΙΤΟΥΣ
1.1 Τι καλύπτει; Τα οχήματα της CycloPath είναι ασφαλισμένα για αστική ευθύνη έναντι τρίτων που καλύπτει το θάνατο, σωματικές βλάβες και υλικές ζημιές τρίτων, συμπεριλαμβανομένων των επιβαινόντων στο όχημα της CycloPath (εκτός του οδηγού της μοτοσυκλέτας) μέχρι του ποσού του 1.220.000 ευρώ, σύμφωνα με τις διατάξεις της ελληνικής ασφαλιστικής νομοθεσίας και τους όρους του ασφαλιστηρίου συμβολαίου της μοτοσυκλέτας.
1.2 Τι δεν καλύπτει; Την κλοπή προσωπικών αντικειμένων που βρίσκονται επάνω ή εντός της μοτοσυκλέτας, τον θάνατο και τις σωματικές βλάβες του οδηγού της μοτοσυκλέτας καθώς και τις υλικές ζημιές στο όχημα της CycloPath, και ό,τι άλλο προβλέπεται στο σχετικό ασφαλιστήριο συμβόλαιο.

2. ΥΠΟΧΡΕΩΣΕΙΣ – ΕΥΘΥΝΗ ΟΔΗΓΟΥ ΜΟΤΟΣΥΚΛΕΤΑΣ
2.1 Σε περίπτωση τροχαίου ατυχήματος ή/και ζημίας της μοτοσυκλέτας, ο οδηγός της μοτοσυκλέτας υποχρεούται: α) να προβεί σε κάθε δυνατή ενέργεια που θα έκανε για το συμφέρον του, με σκοπό τη διάσωση ή/και τον περιορισμό της ζημίας και σε κάθε πράξη, σύμφωνα με την καλή πίστη και τις συναλλακτικές συνήθειες ενός επιμελούς προσώπου, καθώς και β) να δηλώσει ενυπογράφως το ατύχημα αμέσως στην CycloPath, χωρίς υπαίτια καθυστέρηση και το αργότερο εντός της επομένης ημέρας από την ημερομηνία του ατυχήματος ή/και της ζημίας, και να παρέχει κάθε πληροφορία και έγγραφο που είναι αναγκαία, μη προβαίνοντας σε οποιασδήποτε μορφής ενέργεια προς τρίτους που θα σημαίνει αποδοχή ή αναγνώριση ή συμβιβασμό ή διακανονισμό χωρίς γραπτή συναίνεση του ιδιοκτήτη της μοτοσυκλέτας και της ασφαλιστικής εταιρείας.
2.2 Επίσης, σε περίπτωση τροχαίου ατυχήματος ή/και ζημίας της μοτοσυκλέτας: α) με υπαιτιότητα (από πρόθεση ή αμέλεια) του οδηγού της μοτοσυκλέτας, β) από οδηγό που στερείται της άδειας οδήγησης που προβλέπεται από την ισχύουσα νομοθεσία για την κατηγορία του οχήματος που οδηγεί, γ) από οδηγό που κατά το χρόνο του ατυχήματος βρίσκεται υπό την επίδραση οινοπνεύματος ή τοξικών ουσιών σύμφωνα με τον Κ.Ο.Κ., δ) κατά την κίνηση της μοτοσυκλέτας σε οδούς ή/και τοποθεσίες, στις οποίες απαγορεύεται η κυκλοφορία, όπως π.χ. πεζόδρομους, πεζοδρόμια, αεροδρόμια κλπ., ε) όταν η μοτοσυκλέτα μεταφέρει φορτίο ή επιβάτες πέραν του επιτρεπόμενου ανώτατου ορίου σύμφωνα με την άδεια κυκλοφορίας του, στ) από χαλάζι, πλημμύρα, τυφώνα, ανεμοθύελλα, σεισμό, ή άλλη ακραία φυσική διαταραχή, και εφόσον ο οδηγός της μοτοσυκλέτας δεν έλαβε τα αναγκαία προστατευτικά μέτρα για την αποτροπή ζημίας της μοτοσυκλέτας, ζ) στα ελαστικά, στις ζάντες, στα τάσια ή/και στους καθρέπτες της μοτοσυκλέτας, από υπαιτιότητα (πρόθεση ή αμέλεια) ή χωρίς να το αντιληφθεί ο οδηγός της μοτοσυκλέτας, η) από συμμετοχή σε επιδείξεις, σε αγώνες – διαγωνισμούς (επίσημους ή ανεπίσημους) ταχύτητας, ακρίβειας ή δεξιοτεχνίας, ή λόγω επικίνδυνης οδήγησης, τότε ο συμβαλλόμενος/υπογράφων αναλαμβάνει την υποχρέωση και δηλώνει ρητά και ανεπιφύλακτα όπως αποζημιώσει πλήρως την CycloPath για το κόστος επισκευής και αποκατάστασης της μοτοσυκλέτας της CycloPath και τα διαφυγόντα κέρδη της, καθώς και για κάθε άλλο ποσό που τυχόν θα υποχρεωθεί η CycloPath όπως καταβάλλει σύμφωνα με την ελληνική νομοθεσία. Δια του παρόντος ο υπογράφων/συμβαλλόμενος συναινεί ρητά και ανεπιφύλακτα ότι σε περίπτωση μη εξόφλησης από αυτόν του ανωτέρω ποσού, όπως χρεωθεί η πιστωτική του κάρτα με το σχετικό ποσό ή/και όπως αποσταλεί σχετική ειδοποίηση πληρωμής στη διεύθυνση κατοικίας του, καθώς και όπως σε περίπτωση μη εξόφλησης του ανωτέρω ποσού εντός 10 εργασίμων ημερών όπως η CycloPath προβεί σε έκδοση διαταγής πληρωμής και σε κάθε αναγκαία ενέργεια είσπραξής του, όπως π.χ. κατάσχεση, προσημείωση κλπ, παραιτούμενος ο υπογράφων ρητά και ανεπιφύλακτα δια του παρόντος κάθε ένστασής του, ιδίως δε της ένστασης συμψηφισμού, υποκατάστασης, ακυρότητας ή ανυπαρξίας της απαίτησης.

1. INSURANCE COVERAGE TO THIRD PARTIES
1.1 What does it cover?
CycloPath vehicles are insured for third party liability insurance covering death, personal injury and
property damage to third parties, including those aboard the CycloPath vehicle (excluding the
motorcycle driver) up to € 1,220,000, in accordance with the provisions of Greek insurance
legislation and the terms of the motor insurance policy.
1.2 What does it not cover?
Theft of personal belongings on or inside the motorcycle, the death and injuries of the motorcycle
driver as well as damage to the CycloPath vehicle, and everything else covered by the relevant
insurance policy.
2. OBLIGATIONS – MOTORCYCLE DRIVER’S LIABILITY
2.1 In the event of a motorcycle accident and / or damage to the motorcycle, the motorcycle driver
is obliged:
(a) to do everything possible in its best interest to rescue and / or limit the damage and in any act in
accordance with the good faith and the conduct of a diligent person, and
(b) report the accident with a signed statement immediately to CycloPath without undue delay and
no later than the day following the date of the accident and / or injury, and provide all necessary
information and documents, without taking any action to third parties which means acceptance or
recognition or compromise or settlement without the written consent of the owner of the motorcycle
and the insurance company.
2.2 Also, in the event of a motor vehicle accident and / or damage to the motorcycle:
(a) by fault (intentionally or negligently) of the motorcycle driver;
(b) by a driver who does not have the driving license provided for by the legislation in force for the
category of vehicle driving;
(c) by a driver who at the time of the accident is under the influence of alcohol or toxic substances
in accordance with the Code of Conduct;
(d) when riding a motorcycle on roads and / or places where traffic is prohibited, such as pedestrian
zones, sidewalks, airports, etc.,
(e) where the motorcycle carries cargo or passengers beyond the permitted limit in accordance with
its registration;
(f) from hail, floods, hurricanes, windstorms, earthquakes, or other extreme physical disturbances,
and if the driver of the motorcycle has not taken the necessary protective measures to prevent
damage to the motorcycle;
(g) on tires, wheels, hubcaps and / or mirrors of the motorcycle, by fault (intent or negligence) or
without the driver of the motorcycle perceiving it;
(h) by participating in demonstrations, racing competitions (formal or informal) in speed, accuracy
or skill, or because of dangerous driving;
then the party / signatories undertakes and expressly and unconditionally declares that he will fully
reimburse CycloPath for the repair and repair costs of the CycloPath motorcycle and its lost profits,
as well as any other amounts payable by CycloPath according to Greek law. The signatory / party
hereby expressly and unconditionally consents that in the event of non-payment of the above
amount, as his credit card is charged with the relevant amount and / or as a payment notice is sent to
his home address, and as in the case of non-payment of the above amount within 10 business days
as CycloPath issues a payment order and any necessary action for its collection, such as seizure,
annulment, etc., the signatory expressly and unconditionally waiving any objection thereto, in
particular the objection to set-off, substitution, invalidity or non-existence of the claim.

1. COPERTURA ASSICURATIVA A TERZI

   1. Cosa copre?

I veicoli CycloPath sono assicurati per responsabilità civile verso morte, lesioni personali e danni alla proprietà e cose verso terzi, compresi quelli a bordo del veicolo CycloPath (escluso il conducente del motociclo) fino a € 1.220.000, in conformità con le disposizioni della legislazione assicurativa greca e i termini della polizza assicurativa automobilistica.

1. 2. Cosa non copre?

Furto di oggetti personali all’esterno o all’interno del motociclo, morte e lesioni del conducente del motociclo, nonché danni al veicolo CycloPath e tutto il resto coperto dalla relativa polizza assicurativa.

2. OBBLIGHI – RESPONSABILITÀ DEL CONDUCENTE DEL MOTOCICLO

2.1 In caso di incidente in moto e / o danni al motociclo, il conducente della motocicletta è tenuto a:

(a) fare tutto il possibile nel suo migliore interesse per salvare e / o limitare il danno e in qualsiasi atto in conformità con la buona fede e la condotta di una persona diligente, e

(b) denunciare l’incidente con una dichiarazione firmata immediatamente a CycloPath senza indebito ritardo e non oltre il giorno successivo alla data dell’incidente e / o infortunio e fornire tutte le informazioni e i documenti necessari, senza intraprendere alcuna azione verso terzi, il che significa accettazione o riconoscimento o compromesso o soluzione, senza il consenso scritto del proprietario della motocicletta e della compagnia assicurativa.

2.2 Inoltre, in caso di incidente automobilistico e / o danni alla motocicletta:

a) per colpa (intenzionale o negligente) del conducente della motocicletta;

(b) da un conducente che non dispone della patente di guida prevista dalla legislazione in vigore per la categoria di guida del veicolo;

(c) da un conducente che al momento dell’incidente è sotto l’influenza di alcol o sostanze tossiche o stupefacenti in conformità del Codice di condotta;

(d) quando si guida una motocicletta su strade e / o luoghi in cui è vietato il traffico, come zone pedonali, marciapiedi, aeroporti, ecc.,

(e) se la motocicletta trasporta merci o passeggeri oltre il limite consentito conformemente alla sua registrazione;

(f) da grandine, alluvioni, uragani, tempeste di vento, terremoti o altri disturbi fisici estremi e se il conducente della motocicletta non ha adottato le misure di protezione necessarie per prevenire danni alla motocicletta;

(g) su pneumatici, ruote, coprimozzi e / o specchi della motocicletta, per colpa (intenzione o negligenza) o senza che il guidatore della motocicletta lo percepisca;

(h) partecipando a dimostrazioni, gare di corse (formali o informali) in velocità, precisione o abilità o a causa di una guida pericolosa;

quindi la parte / i firmatari si impegnano e dichiarano espressamente e incondizionatamente che rimborserà integralmente a CycloPath i costi di riparazione e riparazione della motocicletta CycloPath e dei suoi profitti persi, nonché qualsiasi altro importo pagabile da CycloPath secondo la legge greca. Il firmatario / la parte con la presente acconsente espressamente e incondizionatamente che in caso di mancato pagamento dell’importo di cui sopra, poiché alla sua carta di credito viene addebitato l’importo corrispondente e / o quando viene inviato un avviso di pagamento al suo indirizzo di residenza e come nel caso di mancato pagamento dell’importo di cui sopra entro 10 giorni lavorativi dal momento che CycloPath emette un ordine di pagamento e qualsiasi azione necessaria per la sua raccolta, come sequestro, annullamento, ecc., il firmatario rinuncia espressamente e incondizionatamente a qualsiasi sua contestazione, in particolare l’obiezione a compensazione, sostituzione, invalidità o inesistenza del credito.

1. COUVERTURE D’ASSURANCE AUX TIERS
1.1 Que couvre-t-il?
Les véhicules CycloPath sont assurés pour une assurance responsabilité civile couvrant la mort, les
blessures et les dommages matériels aux tiers, y compris ceux à bord du véhicule CycloPath (à
l’exclusion du conducteur de la moto) jusqu’à 1 220 000 €, conformément aux dispositions de la
législation grecque sur les assurances et aux conditions de la police d’assurance automobile.
1.2 Que ne couvre-t-il pas?
Le vol d’effets personnels sur ou à l’intérieur de la moto, la mort et les blessures du conducteur de la
moto ainsi que les dommages au véhicule CycloPath et tout le reste couvert par la police
d’assurance correspondante.
2. OBLIGATIONS – RESPONSABILITÉ DU CONDUCTEUR DE MOTO
2.1 En cas d’accident de moto et / ou de dommage à la moto, le conducteur de moto est tenu:
a) de faire tout son possible dans son meilleur intérêt pour sauver et / ou limiter les dommages et
dans tout acte conformément à la bonne foi et au comportement d’une personne diligente, et
(b) signaler l’accident avec une déclaration signée immédiatement à CycloPath sans retard injustifié
et au plus tard le jour suivant la date de l’accident et / ou de la blessure, et fournir toutes les
informations et tous les documents nécessaires, sans prendre aucune mesure à des tiers, ce qui
signifie acceptation ou reconnaissance ou compromis ou règlement sans le consentement écrit du
propriétaire de la moto et de la compagnie d’assurance.
2.2 De plus, en cas d’accident de véhicule à moteur et / ou de dommage à la moto:
a) par faute (intentionnelle ou par négligence) du conducteur de la moto;
b) par un conducteur qui ne possède pas le permis de conduire prévu par la législation en vigueur
pour la catégorie de conduite de véhicule;
c) par un conducteur qui, au moment de l’accident, est sous l’influence d’alcool ou de substances
toxiques conformément au code de conduite;
(d) lorsque vous conduisez une moto sur des routes et / ou des endroits où la circulation est
interdite, comme les zones piétonnes, les trottoirs, les aéroports, etc.,
e) lorsque la moto transporte du fret ou des passagers au-delà de la limite autorisée conformément à
son immatriculation;
(f) de la grêle, des inondations, des ouragans, des tempêtes de vent, des tremblements de terre ou
d’autres perturbations physiques extrêmes, et si le conducteur de la moto n’a pas pris les mesures de
protection nécessaires pour éviter d’endommager la moto;
(g) sur les pneus, roues, enjoliveurs et / ou rétroviseurs de la moto, par faute (intention ou
négligence) ou sans que le conducteur de la moto ne s’en aperçoive;
(h) en participant à des démonstrations, à des compétitions de course (formelles ou informelles) en
vitesse, précision ou habileté, ou en raison d’une conduite dangereuse;
alors la partie / les signataires s’engagent et déclarent expressément et sans condition qu’il
remboursera intégralement CycloPath pour les frais de réparation et de réparation de la moto
CycloPath et ses pertes de bénéfices, ainsi que tout autre montant payable par CycloPath
conformément à la loi grecque. Le signataire / partie consent expressément et inconditionnellement
à ce qu’en cas de non-paiement du montant ci-dessus, sa carte de crédit étant débitée du montant
concerné et / ou qu’un avis de paiement soit envoyé à son domicile, et comme dans le en cas de nonpaiement du montant ci-dessus dans un délai de 10 jours ouvrables à compter de l’émission par
CycloPath d’un ordre de paiement et de toute action nécessaire à sa perception, telle que saisie,
annulation, etc., le signataire renonçant expressément et sans réserve à toute objection y relative,
notamment l’objection de compensation, substitution, nullité ou inexistence de la créance.

1. VERSICHERUNGSABDECKUNG AN DRITTE
1.1 Was deckt es ab?
CycloPath-Fahrzeuge sind versichert für eine Haftpflichtversicherung gegen Dritte, einschließlich
Personen- und Sachschäden an Dritten, einschließlich Personen an des CycloPath-Fahrzeugs (nicht
einschließlich des Motorradfahrers), bis zu 1.220.000 €, gemäß den Bestimmungen der griechischen
Versicherungsgesetzgebung und der Bestimmungen der Kfz-Versicherung.
1.2 Was deckt es nicht ab?
Diebstahl von persönlichen Gegenständen auf oder innerhalb des Motorrads, Tod und Verletzungen
des Motorradfahrers sowie Schäden am CycloPath-Fahrzeug und alles andere, was von der
jeweiligen Versicherungspolice abgedeckt wird.
2. VERPFLICHTUNGEN – HAFTUNG DES MOTORRADFAHRERS
2.1 Im Falle eines Motorradunfalls und / oder einer Beschädigung des Motorrads muss der
Motorradfahrer:
(a) alles Mögliche in seinem besten Interesse zu tun, um den Schaden zu retten und / oder zu
begrenzen, und bei jeder Handlung in Übereinstimmung mit Treu und Glauben und dem Verhalten
einer sorgsamen Person (Due Dilligence), und
(b) Unterzeichnen Sie den Bericht unverzüglich und spätestens am Tag nach dem Datum des
Unfalls und / oder der Verletzung unverzüglich bei CycloPath und stellen Sie alle erforderlichen
Informationen und Dokumente bereit, ohne Maßnahmen zu ergreifen gegenüber Dritten, d.h.
Akzeptanz oder Anerkennung oder Kompromiss-Beilegung oder Regelung ohne schriftliche
Zustimmung des Motorradbesitzers und der Versicherungsgesellschaft.
2.2 Auch im Falle eines Kraftfahrzeugunfalls und / oder einer Beschädigung des Motorrads:
(a) bei Verschulden (vorsätzlich oder fahrlässig) des Motorradfahrers;
(b) von einem Fahrer, der nicht über den Führerschein verfügt, der in den für die Kategorie des
Fahrzeugführens geltenden Rechtsvorschriften vorgesehen ist;
(c) von einem Fahrer, der zum Zeitpunkt des Unfalls gemäß dem Verhaltenskodex unter dem
Einfluss von Alkohol oder toxischen Substanzen steht;
(d) wenn Sie mit dem Motorrad auf Straßen und / oder Orten fahren, an denen der Verkehr verboten
ist, wie z.B. Bürgersteige, Fußgängerzonen, Flughäfen usw.
(e) wenn das Motorrad Fracht oder Passagiere über die zulässige Obergrenze hinaus, gemäß seiner
Registrierung, befördert;
(f) bei Hagel, Überschwemmungen, Wirbelstürmen, Stürmen, Erdbeben oder anderen extremen
physischen Störungen, und wenn der Fahrer des Motorrads nicht die erforderlichen
Schutzmaßnahmen getroffen hat, um Schäden am Motorrad zu verhindern;
(g) an Reifen, Rädern, Radkappen und/oder Spiegel des Motorrads, durch Verschulden (Vorsatz
oder Fahrlässigkeit) oder ohne dass der Fahrer des Motorrads dies wahrnimmt;
(h) durch Teilnahme an Demonstrationen, (formellen oder informellen) Rennwettbewerben in
Bezug auf Geschwindigkeit, Präzision oder Geschicklichkeit oder wegen gefährlichen Fahrens;
dann verpflichtet sich der Beteiligte / Unterzeichner und erklärt ausdrücklich und bedingungslos,
dass CycloPath die Reparatur- und Reparaturkosten des CycloPath-Motorrads und seine
entgangenen Gewinne sowie alle anderen von CycloPath zu zahlenden Beträge vollständig erstattet
werden gemäß geltendem Griechischem Recht. Der Unterzeichner / Beteiligte erklärt sich hiermit
ausdrücklich und bedingungslos damit einverstanden, dass im Falle der Nichtzahlung des oben
genannten Betrags seine Kreditkarte mit dem entsprechenden Betrag belastet wird und / oder eine
Zahlungsbenachrichtigung an seine Heimatadresse gesendet wird und wie im Fall von Nichtzahlung
des oben genannten Betrags innerhalb von 10 Werktagen, CycloPath einen Zahlungsauftrag und alle
für seine Einziehung erforderlichen Maßnahmen ausstellt, wie z Beschlagnahme, Annullierung
usw., wobei der Unterzeichner ausdrücklich und bedingungslos auf jeden Widerspruch verzichtet,
insbesondere auf den Widerspruch der Aufrechnung, der Ersetzung, der Ungültigkeit oder des
Nichtvorhandensein des Anspruchs.
